riserva per i volontari di truppa in ferma prefissata e in ferma.

Il sottoscritto ARPA Francesco, nato ad Oria (BR) il 05.06.1955 ed ivi residente in Via Malpighi, n°8,
PREMESSO:
- che sulla G.U. – 4^ serie speciale concorsi - n°79 del 10.10.2008 alla pag.177 è stato pubblicato il concorso indicato in oggetto;
VISTO:
-l’art. 18 - commi 6 e 7 - del D.Lgs. n. 215/2001:-comma 6. La riserva di cui all'articolo 39, comma 15, del decreto legislativo 12 maggio 1995, n. 196, fermi restando i diritti dei soggetti aventi titolo all'assunzione mandatory under the Legislative Decree 23 November 1988, No 509, as subsequently amended, and Act March 12, 1999, No 68, is high at 30% and applies to volunteers stopped short of pointing fixed term of five years of the three armed forces, dismissed without demerit, even after or during any stale contracted. Competition notices or other measures involving recruitment issued by the administrations, companies, institutions and institutions of the state, regions, provinces and municipalities, must bear the certification of those seats reserved for the entitled. La riserva di cui al presente comma non si cumula con quella prevista dal comma 1.
-comma 7. Qualora la riserva per i volontari di truppa in ferma prefissata e in ferma breve nei concorsi per le assunzioni nelle carriere iniziali delle amministrazioni indicate nei commi 1, 4, 5 e 6 non possa operare integralmente o parzialmente, perchè dà luogo a frazioni di posto, tale frazione si cumula con la riserva relativa ad altri concorsi banditi dalla stessa amministrazione ovvero ne è prevista l'utilizzazione nell'ipotesi in which the administration going recruitment by drawing from the reserve list;

NOTED:

- that the contest in which the subject is rather devoid of this term and indeed, in contrast, the facsimile application shows the following line:" ° it reserves the right to quanto_______, "which, while seems unnecessary when you consider that the text of the announcement there is no reference to any reservation of seats in favor of certain categories is reasonable to think che la riserva stessa all’origine era stata prevista;
- che un caso analogo si è verificato (ed è stato già sanato con delibera di G.M.) nel mese di agosto c.a. nel Comune di Grottaferrata (RM).
CHIEDE:
- di valutare l’opportunità di ANNULLARE, nell’interesse generale, ai fini di una corretta, equa ed imparziale azione amministrativa, il concorso per la copertura a tempo pieno e indeterminato di due posti di istruttore di vigilanza urbana, categoria C - posizione economica C1, come meglio in oggetto indicato, in quanto palesemente viziato da illegittimità per violazione di legge.
Convinto di essere stato propositivo e costruttivo, nonché di aver agito unicamente a beneficio dell’interesse generale, distintamente saluto.
